So with the whole Twitch DMCA fiasco going on, I wonder if streaming unlicensed anime is fine? Anime like Carnival Phantasm are currently unlicensed so would that theoretically be streamable and not fall under DMCA?
No? It's still licensed under Japanese companies that are much more strict with DMCA than other countries.
Not so long ago an anituber that was just reviewing episodes / anime and had half of his channel removed by toei under copyright, I didn't follow it after how it unfolded but it's not a good idea.

the bit about faxes always get me, how can it be both a highly technologically creative country while being so adamantly stuck on the past technology and business models. like uh yeah streaming the actual episodes is probably never going to be a thing, but maybe they'll finally understand what a review is. I have now a good mental image of them trying to dmca roger ebert over his review of spirited away.
Because the streamer gets the credits for the production staff's hard work. Saying you don't take credit for it is just false because you're steering viewers from the licensed copy.
not necessarily true on both accounts. a streamer is likely profiting from streaming said licensed content but he hardly owns it or gets credit for it, otherwise he wouldn't be struck down with a DMCA. and on the second sentence its unprovable to tell if people would've seen it if there was only the licensed option anyways. most anime fans pirate it and its not like the industry isn't making money from those that don't. potential customers doesn't mean they're actual custumers. they just have the potential to be ones, saying otherwise is naive.
